Update on the Civil Liability Bill

This month we have seen the introduction of the government's latest proposals to reform personal injury law. The Civil Liability Bill was presented at its first reading in the House of Lords on 20th March 2018, with the second reading due to take place on 24th April 2018.

Key proposals contained in the bill include:
• Raising the small claims limit for personal injury claims to £2,000, and to £5,000 for all road traffic accident claims;
• Introducing a tariff scheme for whiplash injuries;
• Changing the discount rate calculation, so that claimants are assumed to take on a 'low' investment risk, as opposed to the current assumption of 'very low' investment risk;
• Providing that a review of the discount rate must take place at leastevery three years...
