Driving While Intoxicated: Information, Possible Charges, and Hiring a DWI Attorney - San Antonio, Texas

Consideration was given for the editing and publication of this post.

We, as a nation, always loved alcohol. A celebration would never be complete without any beer or even wine. Friends usually gather in bars to celebrate birthdays or just the idea that they survived another week at work. Teenagers would even sneak out and try to pass off as legal age just to have a taste (although let us be clear, we do not condone any of it). Usually, people would say that having alcohol during a gathering is better because it promotes camaraderie amongst the group. There is nothing wrong with indulging oneself with alcoholic beverages, as some of us refer to it as a tradition and as a pastime. Imagine a Fourth of July party without the beer, or a New Year’s Eve without a toast. Some will say that it is not necessary but you can never erase drinking alcoholic beverages in the American picture. However, this is not a valid reason to drink and drive.

There are many names for this offense depending on the state in which you were pulled over. In Texas, it is known as DWI (driving while intoxicated) and this does not just refer to alcohol ingestion. It can also mean that you are under the influence of a drug (prescription or otherwise). However, sometimes they still use driving under the influence (DUI) or operating under the influence. It is rather a general statement to cover any type of operation of the vehicle that requires you to have normal psychomotor skills, which means can you can be arrested for this offense while not technically driving. This also covers boating while intoxicated (BWI), which is unique to Texas laws. Also, Texas practices “zero tolerance” on underage driving, meaning that minors cannot operate or drive a vehicle when having consumed anything which can compromise their driving.

There are two main criteria for this conviction of DWI. One is a BAC level higher than .8% after testing. The other one is just ingesting any substance which can inhibit your mental and physical capabilities. Texas also requires all drivers to submit to the blood and breathe test as they operate under implied consent. Failure to do this can lead to suspension of your license even before the actual DWI case.

Being convicted with DWI can lead to major consequences. You may have your license suspended for a maximum of 2 years. It is possible that you will be jailed for 72 hours to 10 years. This does not include other possible offenses like destruction of property, illegal substance use and counts of murder. Fines can also get up to $10,000. If you were also using a company vehicle, this can make you lose your job.

All hope is not lost if you were accused of driving while intoxicated and you believe you are innocent. Hiring a DWI attorney can help. These lawyers specialize in these types of cases and they make sure that each and every angle is considered for your protection. There are many instances in which the arrest can be considered flawed. The field sobriety test was also put under question because not all of these tests are very accurate in telling whether the person is really intoxicated or not. There is also the issue about breathalyzers malfunctioning and the person using it is not fully trained.

roadlines

Driving while intoxicated is a serious issue. The road is already full of so many other hazards, and we do not want to add to that. Many lives are involved in this situation, not just for the driver alone. There can others in the car with you, maybe your friends and family. Other people are also using the road, and they can be affected by this, too. To be safe, if you know that you are going to drink, please refrain from driving anymore. This can help you save lives in the process, along with your own, alcohol is considered as a “happy juice” by some but it does not change the fact that it can impair our senses at high amounts. We need to be responsible ourselves so that we will not put each other at risk.
