Darnley v Croydon Health Services NHS Trust [2018] UKSC 50

In this month's edition, we consider in detail the case of Darnley v Croydon Health Services NHS Trust, in which the Supreme Court unanimously held that a hospital receptionist owed a duty of care not to give misleading or inaccurate information about waiting times to a person who presented at the hospital's A&E department. The case raises a host of issues concerning the duty of care - including the scope of the duty owed by A&E departments to members of the public before any professional assessment of that person's medical needs has been undertaken, the circumstances in which recourse should be had to the Caparo test in deciding whether to impose a novel duty of care, and the relevance of the financial and other pressures that A&E departments face in identifying the existence and scope of any duty of care.
