Low Dose Asbestos Litigation: Challenges for Practitioners - Niall Maclean, 12 King’s Bench Walk

10/09/13. The importation of asbestos into the UK has fallen dramatically from about 1970 onwards, yet the number of deaths from mesothelioma has risen equally dramatically from about the same date. The answer to this conundrum lies in the unusual toxicity of asbestos. Mesothelioma is an almost invariably fatal cancer for which the overwhelmingly commonest cause is asbestos exposure. Current scientific opinion appears to be that the condition can be caused by exposure to relatively small amounts of asbestos (perhaps even single fibres), and the period of time that can elapse between exposure and the physical manifestation of cancer can be 40 years or more...
