Alan Philips Associates Ltd v Dowling & Ors, CA (Civ Div) 12/1/2007
A judge was right to make a third party costs order against a director of a company that had had a claim for unpaid fees dismissed and had judgment made against it on a counterclaim, in circumstances where the identity of the director and the company and the interests of the director and of the company were so close that it would be unjust not to make the director liable for costs.
