Summary of Recent Cases - Substantive Law
Cable v Liverpool Victoria Insurance Company Ltd (HHJ Graham Wood QC, Liverpool County Court, 5th July 2019)
The instant case arose out of a road traffic accident on 1st September 2014. A CNF was submitted to the Defendant's insurers, stating that the Claimant had sustained soft tissue injuries to his neck, back, and shoulder, and that the Claimant had required no time off work, and no medical consultation. The Defendant admitted liability shortly thereafter. The first medical report was then received on 28th November 2014. Contrary to the impression given by the CNF, it indicated that the Claimant was off work.
