Case Report: A v Balin Distribution Ltd - Helen Reynolds, Spencers Solicitors

The Claim

The Claimant was working as a HGV driver. He was making a delivery to a site at a school in London. He parked outside the grounds and lowered the tail gate on the lorry in order to access the materials he was to deliver. Due to the weight of the materials it was necessary to use a pump truck, provided by his employer, to transport the materials into the school. When the materials and pump truck were at ground level, the Claimant put the pump truck under the pallet. The materials weighed 1,000kg and the pump truck had a weight capacity of 2,500kg. As he was pulling the pump truck one of the wheels fell off and the pallet fell onto the Claimant’s right foot and ankle. The Claimant was wearing steel capped boots, but this did not prevent injury and the Claimant was knocked to the floor. A number of workmen lifted the weight off his ankle. An ambulance was called and the Claimant was taken to hospital...
